These terms and conditions of purchase (hereinafter “T&C”) shall apply to all sales of products offered through the website www.trantrandance. com (hereinafter “Products”), and together with the offer, price and description of the same set through said website, and, where appropriate, the particular conditions of the same contained in this document (particular conditions), shall govern the legal relationship between TATIPATATI, S.L. (hereinafter, TATIPATATI, “we”, “our(s)/a(s)”, “us”) and the CUSTOMER, making up the entire agreement between TATIPATATI and the CUSTOMER.

The period of validity of these T&Cs shall be the time they remain published on the website, and shall refer to the purchase of Products at the time these conditions were available.

We are sorry, but we can only accept orders placed by persons of legal age. If you are a minor, you must inform your parents or guardians about these T&Cs. Your parents or guardians must express their acceptance of these T&Cs before using this website or making any purchase from this website.

Identification of the parties.

On the one hand, TATIPATATI, S.L., hereinafter “TATIPATATI”, enabler of the web portal www.trantrandance.com, a company incorporated under Spanish law, with registered office at Calle Prim 16, CP 28770, Colmenar Viejo, Madrid, Spain, registered in the Commercial Register of Madrid, Volume 46059, Folio 180, Sheet M-809298 and CIF B56741382.

On the other hand, the CLIENT, of legal age, whose data are those that have been entered by him/her in the corresponding forms. All data included in such forms have been entered directly by the CLIENT, so the responsibility for the authenticity of the same corresponds, directly and exclusively, to the CLIENT.

Object of the contract.

Through the acceptance of these general conditions, TATIPATATI undertakes to make available to the CUSTOMER the Products purchased through the website www.trantrandance.com and the CUSTOMER undertakes to pay the price indicated at the time of purchase.

TATIPATATI does not allow the purchase of the Products offered through its website for subsequent resale. Thus, the accreditation obtained with the purchase of the product is personal and non-transferable.

Registration Process.

In general, for the acquisition of the Products offered by TATIPATATI through the website, prior registration on the website will not be required. However, it is possible that for the purchase of certain products or to access certain services it may be necessary to register on the website, in which case you will be warned by TATIPATATI.

In connection with the registration process, the CLIENT is solely responsible for the quality of the data entered by him/her in the forms, and accepts the obligation to provide truthful, accurate and complete data about his/her identity, as requested in the registration, purchase and accreditation forms, as well as to update all registration data so that they remain truthful, accurate and complete.

The CLIENT may at any time modify and/or update their data by accessing their User profile within the portal, but we recommend that you always confirm that the data entered and/or modified are correct, especially your email address and delivery address of orders, to avoid future inconveniences.

In order to register you must be of legal age according to Spanish law, and you may be a resident of any country in the world.

Once the CLIENT has entered his data and clicked on the registration button, we will send him a confirmation email in order to authenticate the data he has provided during his registration. The sending and receipt of such email is usually automatic and in any case within 24 hours of sending the registration request. If you have not received them in that period of time, it may be due to an occasional failure of communications or an error in the email address you have provided. If the CLIENT provides any false, inaccurate or incomplete information, or if TATIPATATI has sufficient reason to suspect that such information is false, inaccurate or incomplete, it shall have the right to deny access and present or future use of the website, or any of the services.

TATIPATATI will treat your personal data in accordance with current legislation on the Protection of Personal Data and any other relevant legislation.

Products

All information on the Products offered by TATIPATATI, including, but not limited to, prices, characteristics, description, size, content, etc., are available to the CUSTOMER on the TATIPATATI website, and will appear on screen in each case.

We try that the descriptions of the products that the CLIENT will be able to visualize next to each one of them are as exact and useful as possible. However, the colors that the CUSTOMER sees on his screen may vary from the original color of the product.

Prices

The characteristics and prices of the Products are indicated on the screen in Euros and exclude VAT and any other applicable taxes and shall at all times be those in force, except for typographical errors. Such taxes will be displayed on the invoice in an itemized form.

The prices shown on the website override all previously published prices and are valid at the time of publication. TATIPATATI undertakes to make every effort to maintain these prices, although it reserves the right to modify them without prior notice, informing the customer at the time of placing an order. Price changes will not affect orders already placed.

Purchase process.

The products to be purchased must be selected and added to the shopping cart by clicking on the corresponding icon.

After selecting the desired Products, in order to purchase them, the CUSTOMER must access the shopping cart, where he/she must fill in the corresponding purchase form that will appear on the screen, together with a summary identifying the selected Products, their total price, the applicable taxes and, if applicable, the applicable shipping costs.

The verification of such data shall be the sole and exclusive responsibility of the CUSTOMER. TATIPATATI shall not be liable to the CUSTOMER for any errors or inaccuracies in the order if TATIPATATI had sent the Products shown in the order confirmation.

Next, the CUSTOMER must fill in their data and indicate the delivery address of the product. If the CUSTOMER provides any false, inaccurate or incomplete information, or if TATIPATATI has sufficient reason to suspect that such information is false, inaccurate or incomplete, it reserves the right to cancel the CUSTOMER’s purchase. In such a case, TATIPATATI will inform the CUSTOMER, and will proceed to refund the amounts paid, discounting the expenses generated by the transaction, through the same means by which the payment was made, within fourteen (14) days following such communication.

Once the purchase form is completed, the CUSTOMER must accept the present T&C, once accepted, select the desired payment method and confirm the order. Depending on the selected payment method, the CUSTOMER may be redirected to an on-line payment platform where he/she can finalize the purchase through any of the accepted payment systems.

Once the transaction is confirmed, the CUSTOMER will receive a communication by e-mail with the information of his order, as well as the corresponding invoice. The non-receipt of this message may be due to some transitory problem of communications on the network or a typing error in the e-mail address communicated. In both cases, it is advisable to contact customer service through the e-mail address orders@trantrandance.com.

It is also advisable to review the data included in this email, and if you detect any error, please contact customer service through the email address orders@trantrandance.com.

Methods of payment.

It is possible to place orders at any time, 24 hours a day, every day of the week. TATIPATATI will only accept payments made by credit or debit card VISA, MASTERCARD, AMERICAN EXPRESS or by bank transfer. No other form of payment other than those mentioned above will be accepted.

If you select Bank Transfer as payment method, after the completion of the order, the procedure to follow will appear on the screen, as well as the account number to which the transfer should be made. Please note that your bank may charge you commissions for sending the transfer. If you choose this payment option, you will have a period of 72 hours from the completion of the order to make the bank transfer. During these 72 hours the product of your order will be reserved. If we do not receive confirmation of payment within this period of time, we will put the products back on sale and your order will be cancelled. The order will be shipped on the first working day, Monday to Friday, after the payment confirmation.

We will make every effort to make this website secure. In order to ensure the security of payment transactions, TATIPATATI uses a secured payment system. This means that all confidential data (e.g. credit card number and expiration date) are encrypted and transmitted directly to a secure server, using Secure Socket Layer (SSL) technology. However, in the absence of negligence on our part we cannot be held responsible for any loss you may suffer if a third party attempts to gain unauthorized access to the information you provide when accessing this website or ordering from this website.

TATIPATATI will not assume responsibility for delays in the delivery of the goods resulting from the lack of authorization by the bank. TATIPATATI reserves the right to withhold any order for security reasons. Affected customers will be notified. We also reserve the right to cancel the order when we are unable to verify shipping and/or billing information, in which case we will notify you. We also reserve the right not to accept and/or cancel an order if we believe that the buyer wants to obtain the items for resale.

Delivery of products.

TATIPATATI delivers products and services worldwide. Shipping costs will be borne by the CUSTOMER and will appear on the screen at the time of purchase, along with the estimated delivery time.

The orders will be processed within 48 working hours after confirmation of the order and validation of the payment method. We do not ship on Saturdays, Sundays or holidays.

Shipping costs will depend on the shipping address and the specific method chosen for each order. TATIPATATI will always and in any case inform you of the shipping costs prior to placing the order.

The delivery time within the European Union is usually between three (3) and five (5) working days, and for third countries between five (5) and seven (7) days, depending on the shipping address and the chosen payment method. Delivery dates or times should be understood to be approximate in all cases. In special situations such as Black Friday, Sales or Christmas, given the circumstances of the logistics sector, it is possible, in some cases, to increase the usual delivery time of your order.

In case of force majeure that prevents or delays the delivery of the product will be brought to the attention of the CUSTOMER with the proposal of a new date of delivery of the Product without any liability for TATIPATATI. Force majeure shall be understood as any case that prevents the delivery of the order for reasons beyond the control of either party, including but not limited to strikes, war, floods or other natural disasters, lack or impossibility of supply of materials.

Deliveries will be made to the address provided by the CUSTOMER. No deliveries will be made to post office boxes. All deliveries must be signed for upon receipt. Once the goods have been signed for, they are the responsibility of the CUSTOMER.

In order to avoid incidents in the delivery it is essential to fill in the corresponding form correctly, being obligatory to fill in the box related to the contact telephone number and e-mail.

Cancellation and extension of the order.

The CLIENT may cancel the accepted and confirmed order, without any charge and without the need to justify it, as long as the order has not been shipped. To make the cancellation, the CLIENT must contact TATIPATATI by e-mail at orders@trantrandance.com.

If the order has already been shipped, you must wait until it is delivered and follow the provisions of these T&C regarding the right of withdrawal and returns.

Withdrawal.

In the event that the CUSTOMER after receiving the purchased Product is not satisfied, the CUSTOMER has the right to withdraw, in whole or in part, from the purchase of the product(s), within thirty (30) calendar days following the delivery of the order, except in the case of a custom-made or personalized product, in which case the CUSTOMER acknowledges and accepts that due to the special characteristics of such products, the right of withdrawal, return or exchange is forfeited.

The withdrawal period shall expire after the expiration of thirty (30) calendar days from the day on which the CUSTOMER or a third party indicated by the CUSTOMER, other than the carrier, acquired material possession of the goods.

To exercise the right of withdrawal, the CUSTOMER must notify us of his decision to withdraw from the contract by means of an unequivocal statement (e.g. a letter sent by post, telephone or e-mail), either by sending it to the following postal address, to the e-mail address orders@trantrandance.com or by telephone +34915131911.

You may use the model withdrawal form that you can download HERE, although its use is not mandatory.

In order to meet the deadline for exercising your right of withdrawal, it is sufficient that the communication is sent before the expiration of the corresponding deadline.

In any case, in the event of withdrawal, the following requirements must be met:

– The product must be in the same condition in which it was delivered, keeping its original packaging and labeling.
– The return will be made using the same box of the delivery or, failing that, a similar format that guarantees in any case the condition of the product.
– The return of the products shall be made to the address of TATIPATATI S.L., indicated above, and, in any case, no later than within 30 calendar days from the date on which you communicated your decision to withdraw from the contract. The deadline will be deemed to have been met if you return the goods before the end of this period.

In case of withdrawal, TATIPATATI will refund the price paid for the returned products, except for delivery costs, in case the consumer and user has expressly selected a delivery method other than the least expensive ordinary delivery method, no later than thirty (30) calendar days from the date on which the decision to withdraw from this contract was informed.

TATIPATATI will proceed with the refund using the same method of payment that was used to purchase the initial order. TATIPATATI may withhold the refund until it has received the goods, or until it has provided us with proof of the return of the goods, whichever condition is met first.

The CUSTOMER shall only be liable for the diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.

The CUSTOMER shall bear the direct cost of returning the Product.

Partial returns of an order will result in the reimbursement of the price corresponding to the returned product(s).

Returns and exchanges.

If upon receipt of your order you are not satisfied, the CUSTOMER has a period of thirty (30) calendar days from the date of receipt to return the product or exchange the item for another, unless it is a personalized or custom-made product, in which case you acknowledge and agree that due to the special characteristics of the product you lose your right to exchange.

To return or exchange a product, you must inform TATIPATATI by e-mail to orders@trantrandance.com and check that the following conditions are met:

– The product must not be used.
– The product must be returned in the same condition in which it was sent and when possible in its original packaging. If the original packaging is not available, it must be replaced by one of similar size and capacity.

Returns.

TATIPATATI offers a return period of thirty (30) calendar days from the date of receipt of the product.

To request the return of a product, please send an e-mail to orders@trantrandance.com indicating the order number, the delivery date and the product(s) to be returned.

The refund will be made automatically using the same means of payment used for the initial transaction. However, we may withhold the refund until we have received the Products, or until you provide us with proof of the return of the Products, whichever condition is met first.
The direct costs of returning the product(s) shall always be borne by the CUSTOMER, except in the event of a manufacturing or quality defect, where TATIPATATI shall be responsible for the costs of returning the product(s). In no case will be accepted shipments carriage forward.

When a product is returned as a result of a manufacturing or quality defect for which TATIPATATI is responsible, we will take care of collecting the defective product and send another identical product at no additional cost to the CUSTOMER, unless the CUSTOMER requests a refund, in which case the full amount paid for the product will be paid in full within 10 working days. The refund will be made automatically using the same means of payment used for the initial transaction.

Changes.

To request an exchange of a product, you must send an e-mail to orders@trantrandance.com indicating the order number, the delivery date, the product(s) you wish to exchange and the product(s) you wish to exchange them for, as well as the reasons for the exchange.

In the case of exchanges, the CUSTOMER will be responsible for all delivery and collection costs, in addition to customs charges if any. In no case will be accepted freight collect shipments.

Once we have received the product, we will ship the new product to you using the same delivery service that was used for the original purchase.

After-sales service and customer service.

Our Customer Service department has an after-sales service to help solve any problem related to our items or deliveries, offering customers a quick and efficient response.

The products offered through our website are guaranteed for 3 years for manufacturing defects. To make use of the warranty within the established legal period of three years following the delivery of the product, it will be essential to present the proof of purchase. Not covered by the warranty are those cases in which the wear or defect is caused by misuse of the product by the CUSTOMER, or by deficiencies caused by negligence, blows, use or tampering, or materials subject to wear and tear by normal use, as well as those cases in which it has been modified, altered or replaced some of the warranty information or proof of purchase and/or the product has been tampered with or repaired by third parties outside TATIPATATI.

In those cases that justify the use of the warranty, we will opt for the repair, replacement of the article, discount or refund, in the legally established terms.

Intellectual and industrial property.

TATIPATATI guarantees the CUSTOMER to be the owner of the intellectual and industrial property rights over the Products sold and/or, if applicable, to have the necessary authorization for the commercialization of the same through its website.

The CLIENT acknowledges and accepts that the Products, as well as their contents, packaging, materials, etc., are subject to Intellectual and Industrial Property rights, whose ownership corresponds to TATIPATATI and/or third parties.

The acquisition of the Products and browsing the TATIPATATI website shall in no case be understood as a waiver, transmission, license or total or partial transfer to the CUSTOMER of the intellectual and industrial property rights owned by TATIPATI or, where appropriate, by the third party to which they correspond. The CUSTOMER may not in any case alter, exploit, reproduce, distribute or publicly communicate the Web, its contents or the products purchased through the same, without the prior and express authorization specifically granted, for that purpose, by TATIPATATI or, where appropriate, by the third party to which they correspond.

Disclaimer of warranties and liability.

TATIPATATI has taken the necessary measures to ensure the proper functioning of the Web. However, TATIPATATI cannot guarantee the availability of the web at all times, whether due to technical causes, system maintenance tasks, interference, interruptions of Internet service providers or any other cause or failures that occur in the access, operation and operability of the web.

TATIPATATI shall not be liable in case of service failures, malfunctions or any other cause not under its direct control or that has its origin in willful or negligent actions of the user or due to force majeure or attributable to third parties.

Likewise, it shall not assume any liability for direct or indirect damages, consequential damages and/or loss of profits. The CLIENT shall hold harmless TATIPATATI from any liability that may arise from third party claims regarding the infringement of rights that may result from its actions.

Modification of conditions.

TATIPATATI reserves the right to modify this agreement, when deemed appropriate or in order to adapt such texts to legislative or technological changes or to its contractual relationship with third parties. The CLIENT will be duly informed of such modifications.

Partial nullity.

Should any part of these T&Cs be contrary to law and therefore invalid, this shall not affect the rest of the provisions in accordance with the law, and these T&Cs shall remain in force. The parties undertake to renegotiate those parts of the terms and conditions that are invalid and to incorporate them into the rest of the T&Cs.

Applicable legislation and conflict resolution.

These T&C shall be governed by and construed in accordance with Spanish law. The Parties agree to settle any discrepancy or conflict out of court, and only in the event that this is not possible, the parties shall submit to the Courts and Tribunals that correspond by law. In the event that the CLIENT is considered a consumer and user, the Courts and Tribunals of the CLIENT’s domicile will be competent to hear any discrepancy.
